Part 2: Guiding and Support Services.

General Information
This agreement (hereinafter referred to as “this Agreement”) is established by Miyoko Kato, an independent service provider operating under the trade name “Traveling Tokyo with Kids” (hereinafter referred to as “the Service Provider”).
[SECTION A] STROLLER RENTAL SERVICE
Article 1 (General Provisions)
This section applies to a person who borrows a stroller (hereinafter referred to as a “User”) from the Service Provider. Matters not stipulated shall be based on Japanese laws or ordinary customs.
Article 2 (Reservation)
- Reservation Application: Users can make a reservation via web or email. The Service Provider will confirm availability and provide rental conditions (stroller model, fees, etc.) via email. A reservation is confirmed when the User agrees and the Service Provider sends a confirmation email.
- Modify Reservation: Any modification requires consent from the Service Provider.
- Cancellation:
- If canceled for User’s convenience, a prescribed cancellation fee applies.
- If canceled for the Service Provider’s convenience, fees are fully refunded.
- Alternate Stroller: If the exact model is unavailable, the Service Provider may offer an alternative. If refused, the reservation is canceled without penalty to the User.
Article 3 (Rental Terms & Payment)
- Identification: The Service Provider requires a copy of a photo ID (passport/driver’s license) and an emergency contact number.
- Refusal: The Service Provider may refuse service if the child exceeds weight limits, if the User is under the influence of toxic substances, or is associated with antisocial forces.
- Payment: Fees include the basic charge, delivery, and consumption tax. Payment must be made by the designated method (credit card, cash, etc.) upon receiving the item.
- Inspection: The Service Provider inspects all items before lending. The User must confirm the item is in good condition at handover.
Article 4 (Use & Management)
- Responsibility: The User must manage the stroller with the care of a “good administrator.”
- Prohibitions: Remodeling, taking the stroller outside of Japan, or using it for unintended purposes is strictly prohibited.
Article 5 (Return)
- Procedure: Strollers must be returned to the agreed location by the expiration time.
- Extension: Requests must be made in advance. Unapproved late returns will incur a penalty of double the excess charge.
- Non-Return: If a stroller is not returned and the User is unreachable, legal action and search costs will be charged to the User.
Article 6 (Accidents, Breakdown, & Theft)
- Breakdown: Stop use immediately and contact the Service Provider. Repairs due to negligence are the User’s responsibility.
- Accidents: The User must report to the police and the Service Provider immediately. The Service Provider is not liable for injuries or accidents unless caused by willful gross negligence.
- Theft: If stolen, the User must reimburse the market selling price.
- Liability Limit: The Service Provider’s total liability is limited to a maximum of 50,000 yen.
[SECTION B] GUIDING AND SUPPORT SERVICES
Article 9 (Scope of Services)
- Services: The Service Provider provides local guiding, travel support, and information services (accompaniment, basic interpretation, and cultural explanation).
- Not a Travel Agency: The Service Provider is not a licensed travel agency under the Japanese Travel Agency Act. We do not sell or arrange travel packages, transportation, or accommodation.
- Third-Party Services: Any transportation or restaurant costs are arranged and paid for directly by the User. The Service Provider is not responsible for issues caused by third-party providers.
Article 10 (Fees & Conditions)
- Exclusions: Guiding fees do not include transportation, entrance fees, food, or personal expenses unless explicitly stated.
- User Responsibility: The User is responsible for their own safety. The Service Provider is not liable for accidents/injuries unless caused by willful misconduct.
- Health/Special Needs: The User must inform the Service Provider of any health conditions or allergies in advance.
- Itinerary Changes: Schedules may be adjusted due to weather or traffic conditions.
[SECTION C] MISCELLANEOUS PROVISIONS
- Governing Law: This agreement is governed by the laws of Japan.
- Language: In case of discrepancy, the Japanese version shall prevail.
- Delayed Damages: A rate of 14.6% per annum applies to overdue monetary obligations.
- Jurisdiction: Disputes shall be settled in the court having jurisdiction over the Service Provider’s office location.
